Moving to North Carolina? Why your closing involves an attorney

Out-of-state buyers are often surprised by how NC closings work. Here’s the short version.

By Anna Powell Real Estate ·

The problem: Buyers relocating from other states expect a title company to run closing and are surprised to be asked to choose an attorney.
The fix: Pick a closing attorney early, verify wiring instructions by phone, and ask for cost estimates up front.

Do you need an attorney to close in North Carolina?

Yes. In North Carolina, a licensed NC attorney handles the closing. The attorney searches title, prepares or reviews closing documents, oversees signing, and records the deed.

Buyers typically choose the closing attorney. Your agent can suggest several.

Can I close remotely?

Often, yes. Many NC closing attorneys can arrange mail-away signings or remote options. Ask early, especially if you’re still living out of state.

Never wire money based on emailed instructions alone. Call your attorney’s office at a number you’ve verified independently.

Who pays what at closing?

It depends on your contract. On the standard NC Offer to Purchase and Contract, the seller pays the deed excise tax and the costs to deliver clean title; the buyer pays their own loan and title insurance costs.

Ask your lender for a Loan Estimate and your attorney for a settlement statement preview.

General information, not legal, tax, or insurance advice. Confirm details with your agent, attorney, lender, or insurer.
